Terms of Service

By accessing or using Sommelier's Window (the website at sommelierswindow.com and the Sommelier's Window apps for iPhone and Android) or Vox Vin (the Vox Vin iPhone app), each operated by Buckshot Digital Sales Inc. ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

We reserve the right to update these terms at any time. Continued use of the Service after changes constitutes acceptance of the updated terms.

We operate two related products that share the same account system and backend:

Sommelier's Window (website, iPhone and Android) is an AI-powered wine cellar and drinking window tool providing:

• - Wine label scanning and AI analysis
• - Cellar management with drinking window predictions
• - AI food pairing suggestions
• - Drinking window reminders
• - Collection import and export

Vox Vin (iPhone) is an AI-powered wine concierge app providing:

• - Voice sommelier conversations
• - Wine label scanning and AI analysis
• - Cellar management with drinking window predictions
• - AI food pairing suggestions
• - Smart cellar search
• - Drinking window notifications
• - Collection import and export

The AI provides recommendations based on general wine knowledge and should not be considered professional advice.

You must create an account (via Apple Sign-In, Google Sign-In or email, depending on the product and platform) to use the apps, except for any guest features offered in the Sommelier's Window apps. You are responsible for maintaining the security of your account credentials and for all activity under your account.

Age Requirement: You must be at least 21 years of age (or the legal drinking age in your jurisdiction) to use this Service.

Each product has its own subscription. Prices are listed in US dollars and Canadian dollars where a store sets them separately. The price and trial terms shown in the app, the store listing or at checkout prevail, and taxes may apply. Prices in other countries are set by the App Store or Google Play and may differ.

Sommelier's Window Premium

• - Website (Stripe checkout): $2.99 USD per month, or $24.99 USD per year. The annual plan includes a 7-day free trial for new subscribers; the monthly plan has no free trial. Billed by Stripe.
• - iPhone (App Store): Monthly $2.99 USD / $3.99 CAD; Annual $24.99 USD / $34.99 CAD. The annual plan includes a 7-day free trial for eligible new subscribers; the monthly plan has no free trial.
• - Android (Google Play): Monthly $2.99 USD / $4.29 CAD; Annual $24.99 USD / $35.99 CAD. The annual plan includes a 7-day free trial for eligible new subscribers; the monthly plan has no free trial.

A subscription bought on one platform is billed and managed on that platform. Free plan limits apply without a subscription, and Premium removes them.

Vox Vin Pro

• - iPhone (App Store): Monthly $5.99 USD / $7.99 CAD; Annual $56.99 USD / $79.99 CAD. Both plans include a 7-day free trial for eligible new subscribers.

Billing, renewal and cancellation

• - Payment is charged to your Apple ID account, Google Play account or card (website) at confirmation of purchase, or when a free trial ends
• - Subscriptions auto-renew for the same period unless cancelled at least 24 hours before the end of the current period. If you cancel during a free trial before it ends, you are not charged
• - App Store: manage or cancel in your Apple ID account settings, under Subscriptions
• - Google Play: open the Google Play app, then Payments & subscriptions, then Subscriptions
• - Website: use Manage Subscription in your account, which opens the Stripe customer portal
• - Deleting an app or your account does not cancel a store subscription; cancel it in the store
• - Refunds are handled by the store that billed you (Apple or Google) under its policies; we do not provide refunds for partial subscription periods

Vox Vin free features (available without subscription): viewing your cellar, manual wine entry, exporting your collection, and drinking window notifications.

Vox Vin Pro features (require a subscription): voice conversations, AI wine analysis, label scanning, food pairings, smart search, and collection import.

You agree not to:

• - Use the Service for any unlawful purpose
• - Attempt to reverse engineer, decompile, or extract source code from the app
• - Use automated systems to access the Service in a manner that exceeds reasonable use
• - Share your account credentials with others
• - Upload malicious content or attempt to exploit vulnerabilities

We reserve the right to suspend or terminate accounts that violate these terms.

You retain ownership of the wine data you add to the app (tasting notes, photos, ratings, etc.). By using the app, you grant us a limited license to process your data to provide the service (analysis, recommendations, notifications).

Wine analysis, recommendations, food pairings, drinking window estimates, and other AI-generated content are provided for informational purposes only. They may not always be accurate. We are not responsible for decisions made based on AI-generated content.

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Buckshot Digital Sales Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, inaccurate wine analysis, or service interruptions.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

We may suspend or terminate your access to the Service at any time for violation of these terms. You may delete your account at any time through the app or by contacting support.

These terms also apply to the Sommelier's Window plugin for ChatGPT (the "Plugin"). Use of ChatGPT itself is governed by OpenAI's terms. The Plugin does not require a Sommelier's Window account.

• - Informational only: Drinking windows, peak years, status, tasting notes, food pairings, and critic scores are estimates for properly stored bottles. Actual results depend on storage conditions, bottle variation, and personal taste. They are not professional, medical, or purchasing advice.
• - Educational use: The Plugin provides general educational information about how wines age and are stored. It does not sell alcohol, does not facilitate the purchase of alcohol, and does not encourage drinking. Anyone who chooses to drink should do so only where it is legal and only if they are of legal drinking age. The account age requirement in Section 3 applies to Sommelier's Window accounts, which the Plugin does not use.
• - Public analyses: When you ask the Plugin to analyze a wine that is not yet in our database, the resulting analysis is published as a public page on sommelierswindow.com and becomes part of our wine database. Do not submit personal, confidential, unlawful, misleading, or offensive text as a wine name.
• - Usage limits: Creating new analyses is limited (currently 3 per user and 100 in total per day), and we may change or remove limits, decline requests, or remove analyses at any time. You agree not to circumvent limits or use the Plugin for automated bulk requests.
• - Availability: The Plugin is provided "as is" and may be changed or discontinued at any time, subject to Section 8.
